terms and conditions

Area of validity

(1) All deliveries, services and offers are subject to these terms and conditions valid at the time the order is placed.

(2) These terms and conditions are the base of all contracts closed between the viptra.de UG (haftungsbeschaekt), Vitalie Putina, Rombergstraße 10A, 59439 Holzwickede, Germany (referred to as „vipalloywheels.co.uk“ below) and a third party (referred to as "customer" below) concerning the articles offered (referred to as "products" below) at the domains www.vipalloywheels.co.uk and www.sellmyalloywheels24.co.uk. We also offer our customers the opportunity of selling rims, wheels and other products to us. Customers can either be a consumer in terms of § 13 German Civil Code or a business in terms of § 14 German Civil Code and must be of legal age in any case.

(3) The customer accepts the validity of these Terms and Conditions as part of the ordering process by clicking the "I accept the Terms and Conditions" and submitting the complete order form.

(4) Any customer condition will not be accepted, unless vipalloywheels.co.uk accept it’s validity in written form.

(5) If deadlines in days are indicated, these will be understood as working days except Saturdays, Sundays and official German holidays.

 

1. The sale of products via vipalloywheels.co.uk

§ 1 conclusion of contract for the sale of products

1) The listed items on the website represent a non-binding invitation to order the goods. Only when the customer orders the goods, ie ends the ordering process by clicking on the button "Send Order", he / she makes a binding offer to buy the product(s). vipalloywheels.co.uk accept the order by sending an order confirmation via e-mail or by delivering the ordered product to the customer.

(2) Before submitting the order, the customer can view the data at any time and correct any errors.

(3) The essential characteristics of the product can be found in the item description. (5) Basically vipalloywheels.co.uk deliver only within the EU. In exceptional cases shipping outside of the EU is possible. In this case, the possibility of sending and the shipping costs will be requested directly at vipalloywheels.co.uk.

 

§ 2 retention

Until full payment is made, the products remain the property of vipalloywheels.co.uk.

 

§ 3 prices and shipping costs

(1) The prices valid at the time the order will be invoiced. The prices are final, which means they contain the valid German VAT and other price components.

(2) For delivery to a non-EU country the following is valid: vipalloywheels.co.uk names the shipping costs up to CFR or up to the customs office next to the address of the customer. vipalloywheels.co.uk cannot inform the customer about customs, clearance or about any further costs (e.g. D/O fees, LCL fees, etc.) which might arise after the palette reaches the CFR or the customs office. The customer can ask the CFR agent or the customs office to inform him / her about the exact costs which arise after the delivery reaches the CFR or the customs office and which he / she will have to pay.

Any additional costs will have to payed by the customer directly at the CFR or at the customs office. We explicily inform that vipalloywheels.co.uk will not bear any costs which arise after the palette reaches the CFR or the customs office.

Furthermore, we inform that the palette has to be collected by the customer or by a person of trust at the CFR or at the customs office. The palette will not be delivered to the home adress of the customer.

In case the palette reaches CFR or the customs office and is not collected immediately after the customer is called by the shipping agent, it will be returned to cipalloywheels. The payed sum will be refunded to the customer minus all additional costs which vipalloywheels.co.uk is charged with regarding the back haul.

(3) Shipping fees are included in each product description, provided the delivery address is in the EU. Cost of shipping outside of the EU are available upon request. If several products ordered, the total shipping costs will bet he sum of the single shipping costs of all the products ordered. Shipping costs are charged separately in the invoice and are indicated separately.

(4) The delivery of the products is carried out by a delivery service or courier service assigned by vipalloywheels.co.uk. If delivery to the customer is not possible because the products ordered will not fit through the door or the staircase of the customer or because the customer is not present at the specified delivery address, the customer bears the cost of the failed delivery.

(5) The price (purchase price) and shipping costs are due in full immediately.

 

§ 4 Terms of payment

(1) The customer may pay in advance via bank transfer or via PayPal.

(2) viptra.de reserves the right to limit the choices of payment methods depending on the order value, shipment region or other objective criteria.

(3) If payment in advance is chosen as the payment method, viptra.de will send the suctomer the bank details in the order confirmation. The invoice amount is to be remitted within 10 days to the account of viptra.de. The delivery of the product will be delivered upon the receipt of the payment.

(4) The goods remains the ownership of viptra.de until the full payment. Before the transfer of ownership a pledge, transfer, processing or transformation is not permitted without the consent of viptra.de.

(5) vipalloywheels.co.uk is entitled to involve a reliable third party when processing the payment. In default of payment the company viptra.de may dispose of its claims to a debt collection agency and transfer the personal data required to process payments to this third party. In case a third party is involved in the processing of the payment, the payment to the company vipfelgen is made only when the amount has been provided contractually to the third party, so that the third party can dispose of it.

 

§ 5 Delivery

(1) The delivery time is 4-7 business days after receipt of the purchase price.

(3) If a product is no longer available, viptra.de reserves the right not to deliver. Delivery takes place as long as the corresponding article is available. If the product is not available in time because viptra.de cannot receive this article from its own supplier the customer will be informed in time. In such a case it is up to the customer to wait for the product or to cancel the order. In case of a cancellation already made payments will be refunded immediately. Should not all ordered products be available, viptra.de is entitled to make partial deliveries at own expense, if this is reasonable for the customer.

(4) If products are delivered with obvious damages, or if the tilt indicators show an inclination during the transportation, the customer has to claim this to the deliverer immediately before confirming the receipt with his / her signature. In such a case, the claim must be confirmed in written form by the deliverer. viptra.de has to be informed as soon as possible about these damages. A transit damage can only be claimed with the carrier's written confirmation, with high-definition pictures of the goods damage and of the package damage. Not immediately apparent transport damage has to be claimed to the carrier in writing within 24 hours.

(5) viptra.de must be informed by the customer via phone or e-mail about any reclaim within 24 hours after delivery of the goods has been completed. For timely and justified reported defects viptra.de will deliver the same product without defect as soon as possible. The customer has the right of conversion and reduction only if the replacement in an individual case within a reasonable time is not possible. Claims for consequential damages to the defect are excluded.

Complaints which are made later than 24 hours after delivery has been completed will not be considered. A later subsequent return of goods or replacement of shortages is excluded.

(6) If the customer is in default of acceptance or culpably violates other obligations so viptra.de is entitled to demand compensation for the resulting damages, including any additional expenses. Further charges are reserved. The risk of accidental loss or accidental deterioration of the goods is at the time to the customer, in which he/she is in default of acceptance.

§ 6 Cancellation policy

If the customer is a user, he is entitled to the subsequent right of cancellation. A customer is a user, if the purpose of the goods’ use and services ordered can not be attributed to his business or professional activity. An intrepreneur is any natural or legal person or unincorporated organization that trades in the conclusion of the contract in their commercial or independent professional activity.

 

Legal right of cancellation

The customer may cancel a contract within 14 days without indicating any reason for his/her cancellation in written form (e.g. letter, fax, e-mail) or by returning the item if the he/she receives the item is up to this deadline. The period begins with the receipt of this written notification, but not before the customer receives the item(s) and not before we fulfill our obligation of information named in the paragraph 246 section 2 in connection with paragraph 1 section 1 and 2 Introductory Act to the German Civil Code as well as our obligations according to article 312g section 1 sentence 1 German Civil Code in conjunction with paragraph 246 section 3 German Civil Code. For the cancellation it is sufficient to send the item(s) back within the revocation period of 14 days.

Cancellation consequences

In the case of an effective revocation, the mutually received benefits and any benefits derived (e.g. interest) are to be returned. In case the customer cannot return the items in the same condition as received or only in a deteriorated condition, he must insofar compensate viptra.de UG (haftungsbeschränkt) the deterioration of the condition and aby benefit derived. The deterioration and derived benefits are to be compensated by the customer only if the use or the deterioration is due to a use of the item, beyond the consideration of the characteristics and functioning. A transit damage which has not been claimed to the carrier according to § 5 (3) is regardedin a revocation as a use of goods by the customer. "testing the properties and functioning" refers to the testing and evaluation of the respective goods, as it is possible and common in a shop. If the client exercises his right of withdrawal, the customer has to bear the cost of return shipping if the delivered product corresponds to the description of the ordered item. Likewise, the customer has to bear the cost of the the shipping if at the time of the revocation yet the return or the contractually agreed partial payment has been furnished by the customer. If the received item does not correspond to the description of the ordered item or there is a defect in the product, viptra.de UG (haftungsbeschränkt) will carry the shipping costs.

The obligations of reimbursing any payments must be fulfilled within 30 days. The period begins for the customer with the receipt of the revocation or with the return shipment of the goods, for vipfelgen - with their receipt of the item(s).

Exclusion of the right of cancellation

The right does not apply to distance contracts:

a) to provide products that are produced according to customer specifications or clearly tailored to personal needs or which by their nature are not suitable for return or spoil quickly or whose expiration date has passed (alloy wheels on which tyres have been fitted for the customer are regarded as customer specification),

b) the supply of audio or video recordings or software if the delivered data carriers have been unsealed by the customer,

c) the supply of newspapers, periodicals and magazines, unless the customer has given his agreement of contract via phone or

d) if the customer is an intrepreneur, that is a natural or legal person or a legal partnership, at the close of the transaction in their commercial or independent professional activity.

 

§ 7 Warranty

The warranty granted by viptra.de is conform to the German statutory provisions. The limitation period for warranty claims for the delivery of new articles is 2 (two) years and in the supply of used articles 1 (one) year. The limitation period start with the date of passing of the article to the customer. The warranty will expire before the end of 24 or 12 months if the one or more articles are opened improperly or in the case of improper handling of the product, in case of damage of the attached test and security seals or in the case of evidently caused demages by the customer or if a repair attempt was undertaken by the client, or in the case of lack of functioning.

(2) If the delivered items have obvious defects, the customer is asked to inform viptra.de about the complaint within 5 working days. Viptra.de is not liable for manufacturer warranties.

 

B. Purchase of products through vipalloywheels.co.uk

§ 1 conclusion of the contract for selling goods to vipalloywheels.co.uk

(1) We offer customers the possibility sell their own rims / alloys and alloy wheels to us. By filling the form on our website, the customer can offer his own rims / alloys and alloy wheels to us. The customer is asked to give in truthfully the complete data necessary for the price calculation. Depending on the condition of the product offered by the customer a price will be calculated and sent to the customer via email. By sending the products to us, the customer agrees to receive the price calculated and sent to him / her. The delivery of the article to us represents a binding contract of selling the article to viptra.de at the price determined.

(2) The offer may be accepted by viptra.de within 14 days after the customer submits it. The aceptance of the submitted offer by viptra.de is confirmed by an e-mail to the customer's specified e-mail address or by remitting the price calculated to the customer's account.

(3) If the actual condition, which is determined by viptra.de after receipt of the products, differs from the specified condition, viptra.de has the right to reject the offer and cancel the purchase. In this case viptra.de can submit the customer a new price offer for the product via e-mail. The customer may accept this offer within 7 days. The customer has the right to reject this offer and will receive the products back to his indicated address. The customer will bear the shipping costs for the return shipment.

(4) In no case viptra.de is obliged to accept the offer of a customer.

 

§ 2 submission of the purchased products

(1) The customer must carry out the submission within 14 days. The date stamp on the deposit receipt is decisive. If no submission takes place within this period, the offer of vipalloywheels.co.uk will lose ist validity.

(2) vipalloywheels.co.uk bears the shipping or collection costs previously agreed with the seller.

 

§ 3 Payment terms for the purchase

After receipt of the products, the state of the products is checked for the specified and actual state by viptra.de. If there are no claims by vipalloywheels.co.uk, the purchase price will be paid within 10 days. Delays due to incorrect information on bank accounts are not at the expense of vipalloywheels.co.uk.

 

§ 4 Property of the products during the purchasing process

(1) By submission of the offer, the seller insures vipalloywheels.co.uk that he / she is the rightful owner of the product. Furthermore he / she assures that the transfer of ownership succeeds with the knowledge and consent of the rightful owner.

(2) The payment of the purchase price to the customer transfers the ownership of the product to vipalloywheels.co.uk.

(3) The transfer of ownership of the goods from the customer to vipalloywheels.co.uk frees vipalloywheels.co.uk from any third party claims that may be asserted with respect to any existing rights to the product. It also frees viptra.de from any payment or other third party claims in connection with the product (eg, lease contracts, hire purchase contracts, mobile phone contracts, etc.).

 

C. General Section

§ 1 Privacy Policy

(2) If vipalloywheels.co.uk links to other web-sites, vipalloywheels.co.uk declares explicitly that it has no influence on the design and content of linked pages. Therefore vipalloywheels.co.uk dissociates from all contents of linked pages and does not adopt these contents. This statement applies to all links and for all contents of the pages to which the links lead.

 

§ 3 Copyright

All rights regarding the use of texts, images or other pictures on the site are owned by vipalloywheels.co.uk or its licensors. The use (copy, reproduction or modification in whole or partially) without the express consent of vipalloywheels.co.uk is prohibited.

 

§ 4 Final Provisions

(1) All contracts between vipalloywheels.co.uk and the customer are subject to the Right of the Federal Republic of Germany.

(2) As long as the customer is a merchant, a legal entity under public law or a public special asset, the court of jurisdiction for all disputes arising from contractual relationships between the customer and viptra.de ist he seat of viptra.de.

 

§ 5 Changes to Terms and Conditions

vipalloywheels.co.uk has the right to alter these Terms and Conditions one-sidedly, if they are introduced into the contractual relationship with the customer, to the extent necessary to eliminate subsequently emergent equivalence disorders or to adapt to changes in laws or technical conditions. vipalloywheels.co.uk will inform the customer about any alteration of these Terms and Conditions. § 6 Severability clause
